QUESTION:    In a state like Pennsylvania, where all judges run for popular election, do you believe judicial candidates should be permitted to express opinions on issues of public concern? Why, or why not?

JUSTICE OF THE SUPREME COURT
JOB DESCRIPTION

The Pennsylvania Supreme Court is the highest judicial authority in the Commonwealth. In addition to being the final court of appeals, it serves as administrator of the unified court system and is responsible for ensuring that all Pennsylvania courts perform their duties properly. The Court hears decisions of the Superior and Commonwealth Courts and in certain cases, including those involving the death penalty, from the Courts of Common Pleas. It may also assume jurisdiction over any case pending before a lower court that involves an issue of immediate public importance. There are seven Supreme Court Justices, the Chief Justice being the one having the longest continuous service on the Court.  Term: 10 years - Salary: $139,585 - (Vote for one)

ANSWER TO QUESTION: Yes. I believe the people have a right to know the core beliefs and opinions of all candidates, including judges. One of the great criticisms of judicial elections is that the public is not informed regarding its vote. The ability to express beliefs on issues will remedy that. However, the public must understand that a judge is obligated to follow the law regardless of personal beliefs, sometimes rendering a decision inconsistent with those beliefs.

ANSWER TO QUESTION: As part of their right to free speech, the Supreme Court has said that judicial candidates may express their opinions on issues of public importance. In doing this, however, they should say nothing that will interfere with their ability to decide - or appear to decide - cases impartially and according to law. Regrettably, expressions of personal beliefs oftentimes detract from a proper focus on qualifications. Accordingly, merit selection of appellate judges makes sense.

ANSWER TO QUESTION: Judicial candidates should be permitted to express opinions. However, there is a fine line with such expression. As a politician, a judicial candidate may give the impression of pre-judgement and ideological bias. Yet as a judge, an individual must be fair and impartial. The politician who seeks judicial office must have the capacity to reconcile personal convictions with the fair and proper administration of the law because a good judge must possess an open mind and a caring heart.

ANSWER TO QUESTION: In response to our Supreme Court decision in Minnesota v. White, Pennsylvania's Canons of Judicial Ethics were amended to prohibit candidates from making statements that commit the candidate to issues that may come before the Court. Regardless of how I feel personally, as a sitting judge, I am bound by this newest amendment. The public's expectation of fair and impartial judges is undermined if they commit to issues that have yet to appear before them.

JOB DESCRIPTION
The Pennsylvania Superior Court is one of two intermediate appellate courts. It hears all criminal and civil appeals from the Courts of Common Pleas except for death penalty cases and those that are specifically assigned to the Commonwealth Court. The Court has fifteen judges, with the President Judge elected by the members. Judges of the Superior Court must be lawyers and must reside in Pennsylvania for at least a year before their election and for as long as they continue in office.

The expression of opinions on issues of public concern would give voters and litigants a false impression that a judge should decide cases based on his/her personal views. A conscientious exercise of judicial restraint, combined with a mature respect for precedent, guarantees a consistent application of the law. Judicial activism must be avoided.

ANSWER TO QUESTION: Candidates should be permitted to express opinions on issues if they desire. In the past this prohibition was sometimes used as a snare to trap unwary candidates. However, just because you have the license to speak out on issues does not mean it is necessarily prudent. I have signed the PBA Judicial Campaign Advertising Guidelines, voluntarily limiting my options in this area. In addition, there are few single issues that can be adequately expressed in labels or sound bites.

ANSWER TO QUESTION: I believe it unwise for judicial candidates to campaign on position-centered, partisan "platforms". The bedrock of a strong, respected judiciary rests not in how well judges reflect popular sentiment, but on the public's faith that its judges will approach cases with absolute impartiality, integrity, fairness and open minds. The question should not be how a Judge feels about an issue, but whether the Judge can and will apply the rule of law intelligently and evenhandedly.

ANSWER TO QUESTION: The Constitution gives judicial candidates the right to express opinions. Because Judges must be faithful to the law, candidates must be clear that personal views do not represent "campaign promises" or any statement of how they would rule on a particular issue. Thus personal beliefs, which explain who the candidate is, while proper, must be judiciously presented. I believe the electorate has a right to know more than judicial candidates law school and political support.

When a candidate becomes a judge, the elected judge must have preserved his judicial impartiality.
